Terms of Service

Please read these Terms of Service ("Terms") carefully before using the SetForge mobile application ("App") operated by SetForge ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

1. Acceptance of Terms

By creating an account or using the App, you represent that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

SetForge is a fitness tracking application that allows users to log workouts, track progress, view training history, and access coaching and team features. The App is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. Account Registration

To use certain features of the App, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account. We reserve the right to terminate accounts that violate these Terms.

4. Medical Disclaimer

SetForge is not a medical service and does not provide medical advice, diagnosis, or treatment. The content and features within the App are intended for informational and fitness tracking purposes only.

Before beginning any exercise program, you should consult with a qualified healthcare professional, especially if you have any pre-existing medical conditions, injuries, or health concerns. You acknowledge that:

• Physical exercise involves inherent risks of injury
• You participate in any exercise program at your own risk
• SetForge is not responsible for any injury or health issue arising from your use of the App

5. User Responsibilities

You are solely responsible for the accuracy of the workout data, weights, and other information you enter into the App. You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the App complies with all applicable laws and regulations in your jurisdiction.

6. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any portion of the App or its systems
• Interfere with or disrupt the integrity or performance of the App
• Reverse engineer, decompile, or disassemble any part of the App
• Use automated means to access or interact with the App without our express written permission
• Upload or transmit viruses or any other malicious code
• Harvest or collect user information without authorization

7. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of SetForge and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of any workout data or content you enter into the App. By using the App, you grant us a limited, non-exclusive license to store and process your data solely for the purpose of providing the service to you.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and share information about you when you use the App. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

9. Data and Content

We take reasonable measures to protect your data, but we cannot guarantee that data loss will never occur. You are encouraged to maintain your own records of important workout data. We reserve the right to delete your data in accordance with our data retention policies, and we will provide notice where required by law.

If you choose to delete your account, your data will be permanently removed from our systems. This action cannot be undone.

10. Subscriptions and Payments

Certain features of the App may require a paid subscription. If you purchase a subscription:

• Subscription fees are billed in advance on a recurring basis
• You authorize us to charge your payment method on file
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds are handled in accordance with Apple App Store or Google Play Store policies

We reserve the right to modify subscription pricing with advance notice. Continued use of the App after a price change constitutes acceptance of the new pricing.

11. Disclaimers and Limitation of Liability

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SETFORGE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SETFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless SetForge and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

You may terminate your account at any time by using the "Delete Account" feature in Settings. Upon termination, your right to use the App will immediately cease and your data will be permanently deleted.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the App will be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

These Terms constitute the entire agreement between you and SetForge regarding the App and supersede all prior agreements and understandings. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
